Terms & Conditions – Lothian Handyman

Please read these Terms & Conditions (“Terms”) carefully before booking services with Lothian Handyman. By engaging our services, you agree to be bound by these Terms.
1. Definitions
“We”, “Us”, “Our”: Lothian Handyman.
“You”, “Your”, “Customer”: The person, company, or organisation booking our services.
“Services”: Any handyman, maintenance, repair, or related work carried out by Lothian Handyman.
“Agreement”: The contract formed when you confirm a booking with us.
2. Services Provided
Lothian Handyman provides handyman and property maintenance services, including but not limited to: repairs, installations, snagging, carpentry, plumbing (non-gas), decorating, and general household tasks.
We reserve the right to refuse work that we reasonably consider unsafe, illegal, or beyond our expertise.
We do not undertake gas work or electrical work requiring certification by law.
3. Bookings & Cancellations
Bookings must be made in advance via our website, email, or phone.
A minimum booking of 1 hour applies to all hourly jobs.
Half-day and full-day packages must be pre-booked and confirmed in writing.
Cancellations made less than 24 hours before the booking may be charged at 50% of the agreed fee.
If we arrive on site and are unable to gain access, or you cancel upon arrival, the full minimum charge will apply.
4. Pricing & Payment
Rates are clearly stated on our website and may be updated from time to time.
Prices exclude the cost of materials, parking, congestion charges, waste disposal, and other expenses, unless otherwise agreed.
Emergency call-outs and out-of-hours work are charged at premium rates.
Payment terms:
Private customers: Payment is due on completion of the job by cash, bank transfer, or card.
Commercial clients (e.g., landlords, Airbnb managers): Payment terms may be agreed separately, but no later than 14 days from invoice date.
Late payments may incur interest at 5% per month and recovery costs.
5. Materials & Supply of Goods
Where Lothian Handyman supplies materials, these will be charged at cost plus a reasonable handling fee.
Where you supply your own materials, we cannot be held responsible for any defects, shortages, or delays caused by them.
Title to materials supplied by us remains with Lothian Handyman until paid in full.
6. Liability
We will carry out all work with reasonable skill and care.
Our liability is limited to the cost of the services provided.
We are not liable for:
Pre-existing faults or damage in your property.
Consequential losses (e.g., loss of rental income, business interruption).
Delays caused by factors outside our control (e.g., supply shortages, adverse weather, traffic).
Nothing in these Terms limits liability for death or personal injury caused by negligence.
7. Access & Health & Safety
You must ensure we have safe and reasonable access to the work area.
You must inform us of any known hazards (e.g., asbestos, structural issues, defective wiring).
We reserve the right to stop work if conditions are unsafe.
8. Warranties & Guarantees
We guarantee our workmanship for 30 days after completion, unless otherwise agreed.
Guarantees do not cover materials supplied by you or third-party contractors.
Normal wear and tear, accidental damage, or misuse are excluded.
9. Termination
Either party may terminate this Agreement with written notice if the other party commits a serious breach of these Terms.
We may terminate the Agreement if you fail to make payment, provide safe working conditions, or supply accurate information about the job.
10. Complaints
If you are dissatisfied with our services, please contact us within 7 days of completion.
We will investigate and, if appropriate, return to rectify the issue at no extra cost.
Refunds will only be offered at our discretion.
11. Data Protection & Privacy
We will only use your personal information to manage your booking, provide services, and communicate with you.
We do not sell or share your information with third parties without your consent, except where required by law.
12. Governing Law
These Terms are governed by the laws of Scotland.
Any disputes will be subject to the exclusive jurisdiction of the Scottish courts.
